Terms & Conditions Solar PV Insurance Online 

 

General information Introduction

This document describes the terms and conditions under which the insurance cover specified in the policy applies, and the rights and obligations of the parties involved. The provisions in your policy have been tailored to the insurance you have taken out and in case of any differences, this policy shall take precedence over the provisions of these terms and conditions.

Requirement for uncertainty

This agreement meets the requirement for uncertainty as described in Article 7:925 of the Dutch Civil Code where and insofar as the damage suffered, for which compensation has been agreed, is caused by an event for the parties at the time the agreement was taken out: - for which it was uncertain that the event would occur; - it was uncertain that the event would cause damage or that damage would arise in the normal course of events.

Confidentiality

The broker and insurer shall hold and process personal information and company information provided in applying for insurance. The insurer shall use this information in the acceptance and performance of this agreement, for marketing activities, for the purpose of avoiding and combating fraud, for statistical analysis and to satisfy legal requirements. Such information shall be handled in accordance with the "Code of Conduct for Processing Personal Information in Financial Institutions". The Code of Conduct details the rights and obligations of parties involved in data processing. Complaints

Complaints in relation to the performance of this insurance agreement should be sent to the Board of Solar Insurance & Finance (Postbus 4192, 6803 ED Arnhem, The Netherlands). In the event of the complaint failing to be resolved satisfactorily by the Board, the complainant may be able to refer the matter to the Stichting Klachteninstituut Financiële Dienstverlening (KiFiD), Postbus 93257, 2509 AG Den Haag, The Netherlands. The criteria for passing the case to the KiFiD can be found on their website (www.kifid.nl). None of the above shall prejudice the complainant's right to refer the matter to court.
